Georgina Eckhert killed in Goldstream Valley Alaska Roll Over Accident.

The Alaska State Troopers report that Georgina Eckhert, 39, was killed in Goldstream Alaska when the car she occupied slid through a Stop sign, rolled down an embankment, and came to rest upside-down in a pond. The driver and two other passengers, all under 18 years old, were not injured. Here is some of the Alaska Civil law that Ms. Eckhert's family needs to know...

1. Fault Determination: The first step is to determine if the driver of this vehicle did anything wrong, leading in any way to Ms. Eckhert's death. The answer seems clear - Alaskan drivers are not supposed to slide through Stop signs - but it is not 100% certain. The police report will include a full investigation. It also makes sense to hire a respectable Accident Reconstruction (AR) expert to immediately evaluate the scene, and reconstruct exactly what happened. This is important for two reasons: (1) if the driver was not at fault - it would be nice to learn that early before he/she emotionally beats himself/herself up about this accident; and (2) if the driver did drive negligently, insurance claims must be filed ASAP;

2. Weather Conditions: The second step is to immediately get a detailed weather summary for this area. It will be important for the Accident Reconstruction expert;

3. Insurance On The Wet Vehicle: Judging from the photos in the New-Miner, this was a late model vehicle. It very likely had insurance on it. Find out which insurance company covers this vehicle and get a written claim to them ASAP;

4. Insurance On Ms. Eckhert's Private Vehicle: If Ms. Eckhert had another insured vehicle, and at 39 years old she likely did, find out who that insurer is as well. Ms. Eckhert's "Uninsured / Underinsured" motorist insurer is also responsible to help with losses arising from this accident. Insured "family members" - living with Ms. Eckhert at the time of this wreck, may also provide insurance that applies to this losse;

5. Look For Medical Payments Coverage And PIP Coverage: In all cases, ask the insurers about "MedPay" and "PIP" coverage on the vehicle Ms. Eckhert occupied, and her vehicle back home in the driveway. These coverages may provide collateral benefits to the Eckhert family;

6. Wrongful Death Claims: Pursuant to AS 09.55.570 and AS 09.55.580, Alaska allows wrongful death claims. Hire an attorney ASAP to pursue them for Ms. Eckhert's dependents;

7. Statute of Limitations: Remember, you only have two years from when this accident occurred to file a lawsuit, or settle your claims. If you delay past two years, you lose your rights - and the insurance companies will escape paying what they owe. Though it hurts to take action this early, valuable evidence is being lost that could otherwise help Ms. Eckhert's dependents. Please take immediate action. Call an attorney today.

The Eckhert family is in our prayers.
